Next Tuesday, February 10, 2009, new restrictions on lead content in children’s products and the ban on phthalates in toys will go into effect. The CPSC has still not clarified how it will treat sporting goods used by children; a toy or not a toy. The CPSC proposal to make a “case-by-case” determination is not a solution. The lead content restrictions for children’s products will be applied retroactively, making products not meeting the 600 ppm limit non-compliant on February 10th even though they were manufactured in accordance with all safety standards at time of production. The CPSC’s recent one year stay on reporting “testing and certification” for products does not delay the effective date of the new lead and phthalate laws, it just delays the reporting requirement. Only Congress can delay the February 10, 2009 effective date for the new restrictions. SGMA has drafted letters for the industry to send to its Congressional Representatives asking for their help.
